TY - JOUR AU - Ramić, Anel AU - Džanić, Enis PY - 2017/12/10 Y2 - 2024/03/29 TI - Borba protiv terorizma u Bosni i Hercegovini – funkcija policijskih agencija ili obavještajne zajednice JF - Kriminalističke teme JA - KT VL - IS - 5 SE - DO - UR - https://krimteme.fkn.unsa.ba/index.php/kt/article/view/175 SP - 554-562 AB - <p><strong>Inspiracija za rad i problem(i) koji se radom oslovljava(ju):&nbsp;</strong>Ovaj članak analizira aspekte protiv-terorističke borbe u BiH i svijetu, te analizira ciljeve u smislu prevencije, sprečavanja, otkrivanja te kažnjavanja s jedne strane, te zakonom predviđene instrumente borbe protiv terorizma u Bosni i Hercegovini. Analizira se uspješnost primjene navedenih alata u svijetu i BiH, posebno sa aspekta neželjenih efekata određenih represivnih mjera i radnji od strane policijskih agencija. Ovdje se prvenstveno misli na mjere i radnje koje podstiču radikalizaciju, koje kao predmet upotrebe imaju cijele skupine nasuprot pojedinaca indiciranih kao potencijalni izvršioci terorističkih napada te time daljnje otuđuju navedene skupine, kao i aktivnosti koje dekonspirišu izvore i metode na raspolaganju obavještajnoj zajednici i policijskim agencijama čime iste čine manje efikasnim i ugrožavaju daljnji operativni rad.</p><p><strong>Ciljevi rada (naučni i/ili društveni):&nbsp;</strong>Konačni cilj je da se predloži metodološki pristup borbi protiv terorizma koji će ciljano i efikasno upotrebljavati zakonom dozvoljene instrumente protiv pojedinaca ili skupina indiciranih kao terorističke, a sa ciljem prevencije terorističkih aktivnosti i ispunjenjem obaveza prema stranim partnerima koje je Bosna i Hercegovina preuzela.</p><p><strong>Metodologija/ dizajn:&nbsp;</strong>Komparativni pristup i studije slučaja su osnovni metodološki pristup za ovaj rad.</p><p><strong>Ograničenja rada/ istraživanja:&nbsp;</strong>Nedostatnost kompletnih podataka o toku aktivnosti vezanih za protuterorističku borbu, a posebno aktivnosti koje provodi OSA/OBA je osnovni limitirajući faktor u istraživanju.</p><p><strong>R</strong><strong>e</strong><strong>z</strong><strong>ultati:&nbsp;</strong>Očekujemo identifikaciju limitirajućih faktora za uspješnu borbu protiv terorizma ako se nastave trendovi upotrebe policijskih agencija kao nosioca borbe protiv terorizma, a zbog fragmentiranosti policijskih agencija, neadekvatne razmjene podataka, nedostatnosti analitičke funkcije u agencijama, te limitiranosti u smislu operativnih mjera i radnji na raspolaganju policijskim agencijama.</p><p><strong>Generalni zaključak:&nbsp;</strong>Zaključak je da nosioc ovih aktivnosti u Bosni i Hercegovini mora da bude Obavještajno Sigurnosna Agencija zbog specifičnih instrumenata te načina rada, dok policijske agencije trebaju da djeluju kao sistem podrške u protiv-terorističkoj borbi posebno kroz uspostavljene jedinice kriminalističko-obavještajnog karaktera prisutnih u svim kantonima FBiH kao i RS i distriktu Brčko.</p><p><strong>Opravdanost istraživanja/ rada:&nbsp;</strong>Definisanje alternativnog pristupa protuterorističkoj borbi u cilju povećanja efikasnosti i efektivnosti.</p><p><strong>Counterterrorism&nbsp;in Bosnia and Herzegovina - a Law Enforcement or&nbsp;Intelligence Function</strong></p><p><strong>R</strong><strong>eason for writing and research problem(s):&nbsp;</strong>This paper analyses aspects of counter- terrorism operations in Bosnia and Herzegovina and elsewhere; it analyzes goals of CT trough preventive, disruptive, investigative and penal aspects from one side, and legal instruments available in Bosnia and Herzegovina on the other side. The paper addresses success of various instruments in Bosnia and Herzegovina and elsewhere, especially negative side effects of certain repressive measures used by police agencies. We primarily address instruments that incite or support radicalization – instruments that target entire groups rather than individuals indicated as a terrorist threat, as well as instruments that expose methods and sources used by the intelligence community and police agencies, and thus have a detrimental effect on the capabilities of those agencies.</p><p><strong>Aims of the paper (scientific and/or social):&nbsp;</strong>The goal of this paper is to define a methodological approach for CT that will apply defined instruments against individuals and groups of CT interest, in order to prevent and obstruct terrorist activity and serve foreign CT entities Bosnia and Herzegovina cooperates with.</p><p><strong>Methodology/ Design:&nbsp;</strong>Comparative approach and case studies are a primary methodological approach for this paper.</p><p><strong>R</strong><strong>esearch/ Paper limitation:&nbsp;</strong>The lack of full access to data about CT activities, especially ones carried out by OSA/OBA, is a basic limitation of this paper.</p><p><strong>R</strong><strong>esults:&nbsp;</strong>We expect to identify limiting factors of successful CT activities assuming cu- rrent trends of use of police agencies are to be continued. This is primarily due to fragmentation of police agencies in Bosnia and Herzegovina, the lack of intelligence sharing, inadequacy of analytical function, and limited clandestine operational capabilities and experience of police agencies.</p><p><strong>General Conclusion:&nbsp;</strong>Intelligence community has to play a central role in CT activities rather than police agencies, since Bosnian intelligence service has necessary capabilities and tools, while police agencies have to play a supporting role, especially trough the criminal intelligence divisions established in all of the cantons in Federation in Bosnia and Herzegovina, Brcko District and Republic of Srpska.</p><p><strong>R</strong><strong>esearch/ Paper Validity:&nbsp;</strong>The paper will provide alternative framework for more efficient CT activities in Bosnia and Herzegovina.</p> ER -
